Wills – Fee Guidance

It is extremely important to take professional advice from a solicitor in respect of your Will, especially if your assets are complex or if you have children, divorced or remarried.

Our fees are fixed for straightforward Wills and Codicils and are set out below. If your Wills are more complex, we will let you know the extra cost your initial meeting.

Simple Will

  • Single – £250 + VAT (at 20%)
  • Joint (husband and wife or civil partners) – £300 + VAT (at 20%)

Codicil

  • Single – £125 + VAT (at 20%)
  • Joint (husband and wife or civil partners) – £230 + VAT (at 20%)

Lasting Powers of Attorney – Fee Guidance

There may become a time when we are unable to make our own decisions, so may wish to be prepared for this eventuality by appointing someone to act on your behalf.

There are two types of Lasting Power of Attorney. One deals with your property and financial affairs and the other your health and welfare.

Our fees are set out below and includes corresponding with attorneys, acting as certificate provider and all the work in preparing the legal documents.

If you require our firm to register the LPA with the Office of the Public Guardian than there will be an additional fee of £225 + VAT (at 20%) for each document.

Our fees do not include the Court fee for registration which is £82 per Lasting Power of Attorney.

  • Health and Welfare – £225 + VAT (at 20%)
  • Property & financial Affairs – £225 + VAT (at 20%)
  • Both documents at the same time – £400 + VAT (at 20%)
  • Four Powers of Attorney – £800 + VAT (at 20%) (for husband and wife or civil partners)
  • The LPA does not need to be registered on inception. However, if you wish the firm to register, this will incur a further fee of £225.00 plus VAT (at 20%).

Probate – Fee Guidance

In order to administer the estate and obtain a Grant of Probate we will charge on a time basis.

Our current hourly rate is £200 per hour plus VAT (at 20%).

A Value Element of 1% will be charged, based on the value of The Estate, which is a reflection of the importance of the matter and consequent responsibility to the firm.

An average probate matter where no tax is payable takes approximately 6 to 9 months to complete. In a matter where tax is payable the duration is usually between 9 to 14 months.

In some cases, you may wish us to only obtain the Grant of Probate. In such cases, our fee will be approximately £1250 plus VAT (at 20%) and disbursements. This will normally take a duration of 2 months.

Procedure and Timings
There are three main stages to administrating an estate:

1. Ascertaining all assets and liabilities within the deceased’s estate and obtaining values in order to prepare the probate. Depending upon the size of the estate, this takes approximately 3 months.

2. Once the estate has been valued, any tax issues are dealt with and the application for probate is made. This stage takes approximately 1 month depending on the size and complexity of the estate.

3. Once the Grant of Probate is obtained the assets can be realised and any liabilities are paid. The estate can then be distributed in accordance with the Will, or where there is no Will, under the rules of intestacy. This stage usually takes 2-3 months.
